Here at Century Trustees Ltd, we believe in giving a personal 'tailored' service that is not often available from larger organisations. As Trustees we are governed by Trusts (Guernsey) Law 1989, which establishes well-regulated rules in law for the administration of a Trust. However, we also administer trusts written under laws of other jurisdictions such as Jersey and the United Kingdom.
Some basic details are outlined below:
The Concept
Ownership of the asset is transferred from the owner (settlor) to the Trustees; they become the owners of such assets. The settlor is therefore not the owner of those assets, which no longer form part of his/her estate.
The Trustees will then deal with the assets in accordance with the provisions set out in the trust deed. These will have been discussed prior to the inception of the trust and will be geared to cater for the settlor's specific circumstances.
The Advantages:
The deed is a confidential document that does not need to be lodged with any registrar.
Structured and regulated method for assets to devolve to and for the benefit of defined beneficiaries.
There will be no need to grant Power of Attorney to unregulated third parties, which can prove to be risky and unworkable from that which was originally intended.
Tax planning can help ameliorate taxes on the transfer of wealth, in particular, inheritance tax.
The Safeguards
There are various ways in which safeguards can be built into the Trust Deeds - one example being the appointment of a Protector.
A Protector is a trusted friend or advisor whom the trustees would need to consult for important decisions as laid down in the Trust Deed.
